Qld: Children lose preliminary negligence claim against Kenny
BRISBANE, Dec 17 AAP - Two children injured in a 1999 plane crash have lost a preliminarycourt negligence claim against aviation company owner Grant Kenny.
In a Supreme Court decision handed down in Brisbane by Justice Brian Ambrose today,Michael David Cotton and his brother Samuel James Cotton sued Curry Kenny Aviation andrelated companies over a September 1999 plane crash.
The plane crashed on Quail Island, off the central Queensland coast.
They had alleged negligence against Mr Kenny, a former ironman, on the basis he hadselected a pilot with limited experience.
Justice Ambrose threw out that basis for claim, but ordered a separate trial on theissue of vicarious liability.
